NYPD Spouse Sues: Abusive Husband Had Her ‘Falsely Arrested’

New York Civil Rights Lawyer Eric Sanders, Esq., of The Sanders Firm, P.C., alleges in a filing with the New York City Comptroller’s Office that an ‘abusive’ NYPD Captain had his spouse ‘falsely’ arrested  

New York, March 15, 2018, – Mrs. Cathleen Kenny is legally married to Christopher Monahan, a Captain assigned to the Police Department City of New York.

According to the claim, since March 28, 2014, Monahan has subjected her and the minor children to violent drunken outbursts and verbal assaults culminating with her ‘false arrest’ on February 24, 2017, that was ultimately DISMISSED.

Kenny claims, Monahan is a Vice President with the NYPD Captains Endowment Association. Kenny claims, Monahan, along with the entire Board of Directors are on release time as Captains of Police (with other designations), Police Department City of New York compensated with taxpayer and membership monies. According to the claim, Roy Richter, president of the Captains Endowment Association, Monahan and other members of the Board of Directors intentionally use their positions as employees of the City of New York and union officials to ‘physically and mentally attack’ female victims of domestic violence and other related police abuses. Kenny also claims, the City of New York and Police Commissioner James P. O’Neill are fully aware Richter, Monahan and other members of the Board of Directors are engaging in such conduct prejudicial to the good order of the department but, fails to discipline them aka ‘White Shirt Immunity.’

Since March 28, 2014, Kenny claims, she and her minor children are the victims of domestic violence and related police abuses. According to the claim, although the City of New York and O’Neill are required to follow paragraph (c) of subdivision 4 of Section 140.10 of the Criminal Procedure Law (Primary Physical Aggressor), they failed to do so. Kenny claims, Monahan was never arrested, disciplined or terminated causing them irreplaceable harm.

On or about February 22, 2017, Kenny claims, Monahan conspired with then Captains Ebony Washington and Melissa Eger and Deputy Inspector Robert Bocchini setting her up to be ‘falsely arrested’ for Assault in the third degree. Kenny claims, in return, Monahan rewarded them with paid meals and entertainment at Griff’s Place Sports Bar and Grill in Staten Island, N.Y.

According to the claim, on or about February 24, 2018, Detective Richard Dinkle, 122nd Precinct, despite having information Monahan provided ‘false’ information to the police, ‘falsely arrested’ Kenny for Assault in the third degree. Kenny claims, Monahan ‘falsely’ accused her of causing a ‘laceration to informant’s face, bleeding to the informant’s face, annoyance and alarm.’ After Kenny was held in custody about 9 hours, she was Released on Her Own Recognizance (ROR).

Kelly claims, on or about March 1, 2017, based upon the ‘false arrest’ initiated by Monahan her Global Entry Program Membership was ‘REVOKED.’

Kelly claims, on or about March 2, 2017, one of the minor children accused Monahan of Assault in the third degree but, he was never arrested, disciplined, or terminated.

Shortly thereafter, Kelly claims, members of the Internal Affairs Bureau received information that Monahan wasn’t assaulted. Yet, despite receiving information from a direct eyewitness there was no assault, O’Neill failed to suspend and arrest Monahan for Falsely reporting an incident in the third degree.

From March 1, 2017 through May 23, 2017, each time Kenny traveled, she would be detained by the United States Customs and Border Protection due to the ‘false arrest.’ Kelly claims, her employment as a 22-year veteran international flight attendant was in jeopardy due to the ‘false arrest.’

Kelly claims, on or about May 23, 2017, all criminal charges were DISMISSED and records sealed under Section 160.50 (c) of the Criminal Procedure Law.

“This conduct as described by Mrs. Kenny is disgraceful. We’re hopeful one day soon the Department will stop shielding its members with ‘White Shirt Immunity’ and hold them accountable for their actions,” says Eric Sanders.
