The Sanders Firm, P.C.: SDP Miscellaneous Situations
In the section of our website focusing on substantive due process (SDP), The Sanders Firm, P.C. has focused on some of the more common situations related to this violation of your civil rights. The Fifth Amendment and the Fourteenth Amendment to the United States Constitution protect SDP, but the fact is there are many other types of situations where such rights are compromised. On this page we will consider some of those and on the next two subpages we will look specifically at sexual assault and treatment of mental patients.
On our page focusing on privacy and SDP, we highlighted certain scenarios in which privacy is covered. This included the case Griswold v. Connecticut, 381 US 479 – Supreme Court (1965), which focused on the question concerning the government’s power to ban birth control in the bedroom. This particular case is connected to other miscellaneous areas of privacy that are protected by SDP, including sexual privacy, related to sex acts between consenting adults, procreation, and various issues and situations focusing on Lesbian, Gay, Bisexual, Transgender (LGBT) rights to privacy. If you believe that your SDP have been violated, it is important to seek legal advice.
In addition to the above, other SDP areas include the right to travel within the United States, end of life issues, voting rights, and education. Of course, cases dealing with SDP are rarely simple. There are times when our right to travel is controlled, or our right to an education is interpreted different ways by different courts. Voting rights in national and local elections in regards to college students on campuses have changed over the years, as in certain states this constituency finds it much easier to cast their vote on election day in the town in which their college is located. With advances in healthcare and our ability to keep people alive longer, end of life issues have become an important aspect of SDP; our rights to make free choices when our life is near the end or when our qualities of life that have greatly diminished are part of this debate.
SDP Miscellaneous Topics
In the two subpages that are categorized under miscellaneous, The Sanders Firm, P.C. will look at SDP and two more very serious issues- sexual assault and the treatment of mental patients; both of these areas are significant in that in each, our basic liberties may be infringed upon, and each offers us highly complicated and often emotional situations.
