The Fourteenth Amendment to the United States Constitution, which was adopted July 9, 1868, focuses on equal protection of the laws and rights of citizens. This amendment was adopted in order to reverse Black Codes, which were laws passed by various southern states that negated the rights of blacks. In essence, it disallowed individual states from countermanding rights granted by the Constitution.

The Fourteenth Amendment

Section 1 of the Fourteenth Amendment offers equal protection of the laws for everyone. It protects all citizens from discrimination.

Section 1 states, “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”

In New York State, there are also laws that protect those in the state from employment discrimination and other such actions. These are the New York State Human Rights Law (NYSHRL) and the New York City Human Rights Law (NYCHRL) Also, there are various federal laws that offer equal access, opportunity, and pay, including the Immigration Reform and Control Act of 1986 (IRCA).
