The Carey Family Calls for Congressional Action into Miriam’s ‘Avoidable Death’

NEW YORK –  July 12, 2014 – On Thursday, July 10, 2014, after more than nine months of “utter” silence by government officials we were not surprisingly told the United States Attorney for the District of Columbia is declining prosecution. After reviewing the limited data released, we conclude the alleged ‘objective’ investigation is nothing other than an exercise in circular reasoning to reach the result they wanted supporting the police and vilifying our beloved Miriam. Clearly, this alleged ‘objective’ investigation leads to more questions than answers about the police officers’ conduct and ironically supportive of our legal position the shooting was not only ‘avoidable’ but ‘reckless, willful and ‘UNJUSTIFIED.’

We are hereby requesting United States Attorney General Eric H. Holder, Jr., to order the Civil Rights Division, both Criminal and Special Litigation Sections along with the assistance of the Federal Bureau of Investigation to review the alleged ‘objective’ investigation performed by the United States Attorney for the District of Columbia. It is our legal position that one or more police officers from the United States Secret Service and United States Capitol Police violated various criminal and civil rights statutes.

We are further requesting Congressional action. We are calling for independent investigations and hearings by the United States Senate Committee of the Judiciary Chairman Patrick J. Leahy, Jr. and United States House of Representatives Judiciary Committee Chairman Bob Goodlatte using their constitutional investigative powers. Both committee chairs can refer the investigations and hearings to the appropriate subcommittees performing oversight related to constitutional and civil rights. Investigations and hearings into the ‘avoidable death’ of Miriam and other citizens like her are in the public’s interest. Unarmed citizens needlessly dying at the hands of allegedly professionally trained law enforcement officials is a serious problem throughout the United States.

On January 30, 2014, the Carey Family, filed a wrongful death claim against the United States Secret Service – Uniformed Division and the United States Capitol Police seeking $75 million dollars on behalf of The Estate of Miriam Iris Carey, Mother Idella Carey and minor child EF to compensate them for their great loss of a daughter, mother, friend and confidant.

“Despite the United States Attorney for the District of Columbia’s unfortunate but, foreseeable ‘inaction’ the Carey Family will continue with its fight for Miriam’s and her minor child EF’S rights. The United States Attorney for the District of Columbia’s legal position has not changed the Carey Family’s legal position. Again, after an exhaustive review of all publicly available data, the Carey Family has concluded the shooting of Miriam Iris Carey was ‘NOT JUSTIFIED’. Early next week, we will be amending the federal tort claim already filed to add more allegations and claims as well as substantially increasing the request for damages,” says Eric Sanders.
