Fair Trial

Every person is considered to be innocent before proven guilty and have the right to a fair trial. The burden of proof in a criminal case is on the state, and before someone can be indicted, evidence must be offered before a grand jury, which then decides if there is enough evidence for person to be indicted for a felony. If the grand jury votes to indict or return, what is called a “True Bill” then the person will be indicted and arraigned on felony charges. If the grand jury votes to not indict or return, what is called a “No Bill” then the person will not be indicted and if there are no other charges pending, the person will no longer have to deal with the criminal justice system. In some cases, depending upon the nature of the offense, evidence is presented before a grand jury even if the offense is not a felony. However, that does not mean that as a criminal defendant that you do not need to mount a solid defense. In fact, it is your right to offer a defense. The state must prove its case beyond a reasonable doubt and in doing so; a jury must return a verdict on which they agree 100%.

Along with that fact, despite the rights we are given in criminal cases, those in the legal system do not always respect those rights.
