FOR IMMEDIATE RELEASE
NEW YORK, April 21, 2015 – Today, after evaluating the actions of the United States Secret Service and United States Capitol Police in conjunction with the United States Attorney for the District of Columbia and Metropolitan Police Department regarding the ‘alleged’ investigation into the shooting death of beloved Miriam Iris Carey, the Carey family responds by filing a new $200 Million dollar federal tort claim alleging a further government conspiracy.
Prior to the filing of these new federal tort claims, the Carey Family filed an amended wrongful death claim against the United States Secret Service Uniformed Division and the United States Capitol Police on August 20, 2014, seeking $150 million dollars on behalf of The Estate of Miriam Iris Carey, Mother Idella Carey and minor child EF to compensate them for their great loss of a daughter, mother, friend and confidant.
On July 10, 2014, the United States Attorney for the District of Columbia claimed in a press release it and the Metropolitan Police Department conducted a comprehensive review of the incident and after such review, ‘declines to prosecute’ any of the police officers. They concluded there was ‘insufficient evidence’ to prove ‘beyond a reasonable doubt’ the police officers used ‘excessive force’ or possessed the requisite criminal intent to violate Miriam’s constitutional rights. The Carey family was disappointed but, not surprised. “Well, we are obviously very disappointed but, not shocked. We believe the United States Attorney for the District of Columbia along with the Metropolitan Police Department intentionally covered-up the criminal conduct and other wrongdoing in Miriam’s case. Again, we are calling for United States Attorney General Eric H. Holder, Jr., to have this case thoroughly reviewed by the Federal Bureau of Investigation along with the Civil Rights Division, Miriam’s constitutional rights were obviously violated. We are still calling for full disclosure of the investigation for public review” says Eric Sanders.
On September 5, 2015, and November 3, 2014, both the United States Secret Service and United States Capitol Police DENIED the federal claims.
On February 12, 2015, an anonymous letter was received at THE SANDERS FIRM, P.C., signed “Concerned Employees” outlining alleged deficiencies in the training of the United States Capitol Police personnel as well as the operation of the security “pop-up” barrier equipment. In addition, encouraging the Carey family to fight on especially for Miriam’s minor child.
After serious consideration, on April 20, 2015, the Carey family decided to file new federal tort claims alleging a further government conspiracy.
“The United States Secret Service and United States Capitol Police in conjunction with the United States Attorney General for the District of Columbia and Metropolitan Police Department actively and fraudulently concealed both agencies role, as well as a FULL and complete disclosure of the facts and circumstances leading to the shooting death of our beloved Miriam Iris Carey, directly impeding our ability to assert our constitutional, civil, statutory and related common law rights” says Valarie Carey, Sister and Spokesperson for the Carey family.
“Quite frankly, the federal government is being very very disingenuous. From President Obama, Outgoing Attorney General Eric Holder, the Congress and even the American people repeatedly have called for FULL disclosure in a host of police shootings across American cities but, failed to do so here. Since Miriam was killed, there have been a host of seemingly endless security breaches at the White House and United States Capitol with vastly different results. We have, for that matter, the American people have an absolute right to know, why the police in Washington used deadly physical force against Miriam, an unarmed woman operating a passenger vehicle with a toddle in the rear seat. From the outset, the federal government employed dilatory tactics to frustrate the Carey family in their pursuit for justice. Very very disgraceful and un-American” says Eric Sanders.
