Medgar Employee Says ‘Demoted For Blowing Whistle’

New York Civil Rights Lawyer Eric Sanders, Esq., of The Sanders Firm, P.C., alleges in a federal lawsuit filing that Medgar Evers College Stationary Engineer claims he was demoted and unfairly disciplined for blowing the whistle about Administrative Building No.: 1 opening amidst fraud, corruption and serious safety violations

 

New York, March 5, 2016 – According to the lawsuit, Mr. Jean Jeune, during winter 2007 the City University of New York (CUNY) began construction of Administrative Building No.: 1, aka AB1.

According to the lawsuit, Mr. Jeune claims in or around winter 2007 the City University of New York (CUNY) and Dormitory Authority of the State of New York (DASNY) though its vendor partnership with The McKissack Group and Turner Construction acting as the General Contractors begin construction on the MEC AB1 located at 1150 Carroll Street Brooklyn, N.Y. The AB1 building is an approximately 190,000 square foot, five (5) story building to house the School of Science, Health and Technology including thirteen (13) general classrooms, five (5) computer laboratories and a three hundred fifty (350) seat dining hall and kitchen. Mr. Jeune claims according to the suit CUNY and DASNY financed the construction of AB1 using funds allocated by the City of New York and State of New York, the final cost to taxpayers approximately $247 million dollars.

Mr. Jeune claims in or around spring 2009 CUNY and DASNY hired vendor partner Hudson Meridian aka Meridian, a professional construction management firm to oversee the construction and turnover certification of AB1. Meridian, as a vendor partner of CUNY and DASNY was paid more than one million dollars ($1,000,000.00) of taxpayers’ monies to supervise the commissioning of AB1 including the installation of furniture and lab equipment, training of staff, etc. However, instead of ensuring AB1 would be delivered in a cost efficient and safe manner, Meridian intentionally covered up fraud, corruption and waste of taxpayers’ monies creating dangerous conditions within the life safety systems and other systems at AB1 compromising the physical safety of employees, students and other stakeholders of the community, according to Jeune’s claims. Jeune asserts, Meridian as CUNY and DASNY vendor partner intentionally covered up fraud, corruption and waste of taxpayers’ monies to increase profit for themselves and agents’ of CUNY and DASNY.

Mr. Jeune alleges major safety deficiencies of the boilers, fire alarm systems, electric panels, defective gas valves, inability to detect natural gas and carbon monoxide.

Jeune claims in retaliation for complaining about fraud, corruption, waste of monies and safety violations at AB1, he was demoted from the position of Chief Stationary Engineer and subjected to suspensions, charges and other forms of unfair discipline.

Mr. Jeune asserts, Rudolph F. Crew; Jerald Posman; Donovan Allen and Brian Clarke in collusion with CUNY and DASNY retaliated against him, demoted from the position of Chief Stationary Engineer and subjected to suspensions, charges and other forms of unfair discipline, violating his civil rights under the Civil Rights Act of 1871, 42 U.S.C. § 1983 and the First Amendment of the United States Constitution for reporting that CUNY and DASNY, their agents’ and vendor partners intentionally covered up fraud, corruption and waste of taxpayers’ monies creating dangerous conditions within the life safety systems and other systems at AB1 compromising the physical safety of employees, students and other stakeholders of the community and avoidable increased construction costs to the taxpayers.
